Vibe Panels Terms & Conditions

These Terms of Use explain the rules that apply when you purchase, install, activate, access or use Vibe Panels. By installing, activating, licensing or using Vibe Panels, you agree to these Terms.

These Terms apply specifically to Vibe Panels and should be read alongside the main Vibe Suite Terms of Use, the Vibe Panels Privacy Notice, the Vibe Suite Privacy Policy, and any terms that apply through the platform where you purchased the plugin.

1. About Vibe Panels

Vibe Panels is a WordPress plugin designed to create scroll-driven horizontal panel layouts, optional sequential fade transitions, Dynamic Drift visual effects, progress indicators and Elementor-based visual layout controls.

Vibe Panels is intended for use by website owners, developers, designers, agencies and authorised administrators who manage WordPress websites.

2. Who may use Vibe Panels

You may use Vibe Panels if you are legally able to enter into a contract, have authority to manage the website where the plugin is installed, and agree to follow these Terms.

If you install or activate Vibe Panels on behalf of a business, client, organisation or other person, you confirm that you have authority to do so and that they agree to these Terms.

3. Licence to use the plugin

When you purchase or are granted access to Vibe Panels, Vibe Suite gives you a limited, non-exclusive, non-transferable licence to install and use the plugin in accordance with these Terms and the licence type you purchased or were issued.

Your licence allows you to use Vibe Panels. It does not transfer ownership of the plugin, source code, design, branding, documentation, licensing systems, update systems or related intellectual property to you.

The number of websites, activations, domains, environments or users allowed under your licence will depend on the licence type, product listing, purchase record, activation record or written agreement that applies to your purchase.

4. Licensing and activation

Vibe Panels requires a valid licence to activate licensed features, verify product access, receive updates and use the plugin in accordance with these Terms.

Activation may require your purchase email address, licence key, website URL, home URL, administrator email address, selected plugin source, licence status, Terms acceptance status and related licensing information.

Licensing validation may involve requests to a Vibe Suite activation server. Gumroad purchases are validated through the Vibe Suite activation service rather than directly by this plugin. Direct licensing may use a server source provided with the licence.

5. Terms acceptance records

During activation, Vibe Panels may ask an authorised administrator to accept the applicable Terms. The acceptance record may include the accepted Terms version, acceptance timestamp, acceptance status and a snapshot of the accepted Terms text.

This record is used to support licensing, product access, account administration, audit, dispute handling and contractual record keeping.

6. Licence keys and account security

You are responsible for keeping your licence key, purchase details, administrator account and website access secure. You must not publish, share, resell, leak, distribute or expose your licence key or activation credentials.

If you believe your licence key has been misused, exposed or compromised, you should contact Vibe Suite using the contact options provided on the Vibe Suite website.

7. Moving a licence

Some licence types may allow activation to be moved from one website to another. Where this is supported, the activation system may require the previous site binding to be released, replaced or moved before the licence can be used on a different website.

Vibe Suite may refuse, limit or review licence moves where there is evidence of abuse, unauthorised sharing, excessive activations, fraud or use outside the purchased licence type.

8. Updates

A valid licence may be required to receive plugin updates. Updates may include bug fixes, security improvements, compatibility adjustments, performance refinements, feature changes, licensing changes or other product improvements.

Vibe Suite may change, add, remove, rename, replace or improve features over time. Not every update will include new features. Some updates may be released to improve stability, security, compatibility or licensing behaviour.

You are responsible for testing updates before using them on a live production website, especially where the website uses custom code, complex Elementor layouts, caching, optimisation plugins, third-party scripts, unusual hosting rules or other plugins that may affect front-end behaviour.

9. Compatibility

Vibe Panels is designed for WordPress and Elementor. It may also interact with the active theme, hosting environment, browser behaviour, caching layers, optimisation tools, animation libraries, scripts and other plugins installed on the website.

Vibe Suite aims to maintain sensible compatibility with supported WordPress and Elementor environments, but cannot guarantee that Vibe Panels will work perfectly with every theme, plugin, server configuration, browser, custom script, page builder extension, optimisation tool or hosting platform.

You are responsible for checking that Vibe Panels is suitable for your website, stack, accessibility requirements, performance requirements and client requirements before using it on a live website.

10. Backups and testing

You should keep appropriate backups before installing, updating, activating, deactivating or removing Vibe Panels.

You should test Vibe Panels on a staging site, development site or backup copy where possible before using it on a live production website.

Vibe Suite is not responsible for damage, downtime, data loss, layout breakage, missed sales, lost enquiries, ranking changes, performance issues or other problems caused by failing to test, back up or manage a website appropriately.

11. Website owner responsibilities

You are responsible for the website where Vibe Panels is installed. This includes your content, layouts, media, accessibility, privacy notices, cookie notices, legal compliance, user permissions, hosting, backups, security, performance and third-party services.

You are responsible for ensuring that any images, videos, text, fonts, scripts, embeds or other materials used inside Vibe Panels are lawful, properly licensed, accurate and appropriate for your website.

You are responsible for ensuring that your website complies with any laws, regulations, platform rules, accessibility standards, privacy requirements, cookie requirements, consumer protection rules or industry obligations that apply to you.

12. Privacy and data protection

Vibe Panels is not designed to collect personal data directly from front-end visitors. It may process limited administrator, website and licensing data as explained in the Vibe Panels Privacy Notice.

You are responsible for explaining your own use of Vibe Panels, Elementor, WordPress, analytics tools, cookies, embeds, forms, media and third-party services in your own website privacy information where required.

You should not use Vibe Panels to collect passwords, sensitive records, private customer data or information that the plugin is not designed to process.

13. Cookies and tracking

Vibe Panels is visual and runtime focused. It is not designed to add advertising trackers, behavioural analytics cookies or marketing pixels.

You are responsible for any cookies, local storage, session storage, tracking pixels, analytics scripts, consent tools, embedded media or similar technologies introduced by your website, theme, hosting, Elementor setup, analytics provider, security tools or other plugins.

14. Support

Support availability may depend on your licence type, purchase route, product status and support policy in place at the time support is requested.

Support may include reasonable help with installation, activation, licensing, plugin settings, product behaviour and known issues. Support does not include custom website builds, bespoke design work, third-party plugin debugging, hosting management, legal advice, accessibility audits, SEO work, custom development or recovery of websites that were not backed up unless Vibe Suite agrees otherwise in writing.

When requesting support, you may be asked to provide relevant details such as your plugin version, WordPress version, Elementor version, theme name, browser, hosting environment, screenshots, error messages or steps needed to reproduce the issue.

15. Refunds

Refund rights may depend on where you purchased Vibe Panels, the terms of the sales platform, the licence type, the payment provider and any statutory rights that apply to you.

Nothing in these Terms is intended to remove or reduce any statutory rights that cannot legally be excluded.

If you believe you are entitled to a refund, please use the relevant support, purchase or contact route provided by Vibe Suite or the platform where you purchased the plugin.

16. Acceptable use

You must not use Vibe Panels in a way that is unlawful, abusive, fraudulent, harmful, misleading, infringing, malicious, discriminatory, exploitative or intended to damage websites, services, users, systems or networks.

You must not use Vibe Panels to distribute malware, spyware, harmful code, deceptive content, unlawful material, stolen material, unauthorised tracking, phishing pages or content that infringes another person’s rights.

17. Restrictions

You must not copy, resell, redistribute, sublicense, share, publish, leak, rent, lend, commercially exploit or provide Vibe Panels to others except where your licence or a written agreement with Vibe Suite allows it.

You must not reverse engineer, decompile, modify, bypass, disable, remove or interfere with the licensing, activation, update, signature verification or access control systems unless this is expressly allowed by law or agreed by Vibe Suite in writing.

You must not falsely present Vibe Panels as your own product, remove Vibe Suite branding where it is required, or use Vibe Suite names, marks, logos or product identities in a misleading way.

18. Intellectual property

Vibe Panels, including its code, design, interface, branding, documentation, product name, licensing systems, update systems and related materials, is owned by Vibe Suite or its licensors.

You keep ownership of your own website content, media, layouts and materials. Using Vibe Panels does not give Vibe Suite ownership of your website content.

19. Third-party platforms and services

Vibe Panels may be purchased, licensed, updated or validated through third-party platforms or services, including sales platforms, payment providers, hosting services, WordPress, Elementor, Gumroad or a Direct licensing server.

Those third-party platforms and services may have their own terms, privacy notices, refund rules, technical limits, availability, account requirements and support routes. You are responsible for reviewing any third-party terms that apply to your use of those services.

20. Availability and service interruptions

Vibe Suite aims to keep licensing and update services reasonably available, but does not guarantee uninterrupted access to activation servers, update servers, sales platforms, support channels or third-party services.

Temporary outages, maintenance, hosting issues, network issues, platform changes, security measures, payment provider issues, API changes or other events may affect activation, validation, updates or support access.

21. Product changes and discontinuation

Vibe Suite may improve, change, rename, replace, suspend or discontinue parts of Vibe Panels where reasonably necessary for security, compatibility, legal, commercial, operational or product development reasons.

Where practical, Vibe Suite will aim to avoid unnecessary disruption to existing licensed users, but some changes may affect workflows, settings, compatibility or available features.

22. Limitation of liability

Vibe Panels is provided for use as a WordPress visual layout plugin. You are responsible for deciding whether it is suitable for your website and for using it appropriately.

To the fullest extent allowed by law, Vibe Suite is not responsible for indirect loss, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, loss of opportunity, website downtime, search ranking changes, third-party plugin issues, hosting issues or consequences caused by your website configuration, third-party services, custom code or failure to maintain backups.

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any statutory rights that cannot legally be excluded.

23. No professional advice

Vibe Panels is a software product. It does not provide legal, financial, accessibility, privacy, security, SEO, tax, accounting or professional advice.

You should take appropriate professional advice where your website, business, client work, data processing, accessibility requirements or legal obligations require it.

24. Termination

Vibe Suite may suspend, revoke or terminate access to licensing, updates or support where there is evidence of fraud, chargeback abuse, unauthorised sharing, licence misuse, unlawful use, security abuse, breach of these Terms or use outside the purchased licence type.

You may stop using Vibe Panels at any time by deactivating and removing the plugin from your website. Deleting the plugin from WordPress may not delete licensing, purchase, support, accounting, server, backup or legal records held elsewhere.

25. Changes to these Terms

Vibe Suite may update these Terms from time to time. Updates may be made to reflect product changes, licensing changes, legal requirements, operational changes or improvements in wording.

The Terms version accepted during activation may be recorded for licensing and contractual record keeping. Continued use of Vibe Panels after updated Terms are made available may mean that you accept the updated Terms, where this is permitted by applicable law.

26. Governing law

These Terms are intended to be governed by the laws of England and Wales unless another law is required to apply by consumer protection rules or another written agreement with Vibe Suite.

If you are a consumer, you may have mandatory rights in your own country or region that are not affected by this clause.
